Registering a will under DIFC rules follows a clear process that is meant for non-Muslim residents in Dubai. Each step must be completed in a specific order to ensure everything is recorded correctly. The process is completed through the DIFC wills and Probate registry at the final stage of registration.
Check eligibility:
Only non-Muslims over the age of 21 can register a will under DIFC rules. The person must have assets in the UAE or have children living in the country. It is also important to check that the will follows the format approved by the DIFC. The registry accepts English-language wills and does not follow Sharia-based inheritance.
Choose the type of will:
The DIFC Wills Service Centre offers different types of wills. These include full wills, guardianship wills, property wills, business owners’ wills, and financial asset wills. Each type covers specific matters. For example, a property will only relates to real estate, while a full will can include all personal and financial items.
Prepare the draft:
Once the type of will is selected, the next step is to prepare the draft. This can be done by the person writing the will or with help from a legal adviser. The draft should clearly mention all assets, names of beneficiaries, guardianship choices (if any), and details of the executor. It must follow the format outlined by the DIFC Wills Service Centre.
Book an appointment:
After completing the draft, the next step is to book a registration appointment. This appointment can take place either in person at the DIFC Wills Service Centre or online through a virtual meeting. The person registering the will must bring identification documents, the final draft, and any supporting papers requested during the booking process.
Attend the registration meeting:
At the appointment, the draft will be reviewed, and the identity of the testator (the person creating the will) will be confirmed. The will is then read aloud, and the person must confirm that all details are accurate. The will is signed and officially registered during this meeting.
Store the registered will:
Once the will is registered, it is stored securely by the DIFC Wills Service Centre. A copy is given to the person who made the will. This step finishes the process. The registered will remains active unless updated or replaced.
